The Federal Competition and Consumer Protection Commission has urged Nigerians involved in housing-related disputes to report such cases, stressing that consumer protection laws cover major financial commitments such as real estate transactions.

The Commission gave the advisory on Monday in a statement posted on its official X handle, while confirming enforcement action at a residential estate in Abuja.

Paradise Estate Sealed Over Complaints

The FCCPC said it had sealed Paradise Estate Abuja following complaints from homebuyers who alleged that they paid in full for properties but had not received the homes.

According to the Commission, the enforcement action followed a review of multiple petitions submitted by affected subscribers.

Consumer Protection Covers Housing

The agency emphasized that consumer protection is not limited to everyday purchases but also extends to high-value investments such as housing.

It stated that many Nigerians commit life savings based on developers’ promises, making accountability in the real estate sector critical.

Developers Must Honour Agreements

The FCCPC stressed that businesses must not make promises they cannot fulfil and must adhere strictly to agreed terms.

“Where payment has been received, agreed timelines must be honoured, delays properly explained, and lawful remedies provided where obligations are unmet,” the Commission said.

It added that trust in the housing sector depends on transparency, proper documentation, and delivery of agreed services.

Call for Consumer Action

The Commission urged affected consumers to submit complaints alongside payment evidence and relevant documents through its official complaints portal at complaints.fccpc.gov.ng.

Tensions are mounting at Blue Fountain Estate in Karsana, Abuja, as residents have openly challenged the estate developer, Blue Fountain Properties Limited (BFPL), an affiliate of EFAB Properties Limited, over what they describe as systemic violations of housing regulations and actions that jeopardize public safety.

The grievances were brought forward by the Blue Fountain Estate Homeowners and Residents Association (BFEHORA), whose leaders say relations between residents and the developer have sharply deteriorated over alleged breaches of contract, financial opacity, and the conversion of public infrastructure into private residential plots.

Speaking on behalf of the association, Chairperson Olopade Afeez and Vice Chairman Ahmed Dandare said that the developer, under the leadership of Fabian Nwaora, has imposed facility management agreements on homeowners without due consultation.

“These agreements were unilaterally imposed, leaving residents with no voice or input,” the officials said.

The association also alleged that BFPL has supported an unauthorized group designed to undermine the officially recognized residents’ association. According to BFEHORA, this move is part of a broader attempt to evade accountability, particularly regarding facility fees collected for over a decade. “Residents have the right to know how their money is being spent, yet no audited financial statements have been presented since 2016,” the association noted.

Adding to the concerns are claims that areas initially designated for public amenities—such as parks, recreational spaces, and community centers—have been converted into residential plots for sale, in direct violation of the estate’s approved master plan.

“This leaves a community of approximately 2,000 housing units without access to essential social infrastructure,” the association said.

Safety concerns have also been raised. Residents point to a recent fatal fire incident in the estate, the absence of a functional fire station, and porous estate boundaries that have exposed residents to armed robbery and kidnapping incidents.

Over the years, poor waste management has further exacerbated health and environmental risks for the estate’s more than 1,900 families.

In response to these issues, BFEHORA is demanding immediate action from authorities.

Their calls include: an independent forensic audit of the estate’s finances; suspension of facility fee payments pending audit results; intervention by the Federal Capital Territory administration; restoration of contractual order; delivery of promised infrastructure; and a full handover of estate governance to residents.

They are also urging law enforcement to issue a cease-and-desist order to the developer to prevent intimidation of residents or association officials.

The association emphasized that while they remain committed to the rule of law, they will no longer tolerate what they describe as exploitation of homeowners and investors. “We remain calm, resolute, and united in defending our lives, peace, and hard-earned investments,” BFEHORA stated.

Efforts to reach BFPL chairperson Fabian Nwaora for comment were unsuccessful, as he neither answered calls nor responded to text messages. The situation has left residents anxious and frustrated, highlighting broader concerns about accountability and transparency in the rapidly expanding real estate sector in Abuja.

Chairman of the Economic and Financial Crimes Commission (EFCC), Ola Olukoyede, has revealed that many abandoned estates in Abuja are owned by people who have stolen public funds.

Olukoyede made the statement on Wednesday in Abuja at a policy dialogue organised by Law Corridor with the theme, “Critical Issues Affecting Nigeria’s Real Estate Ecosystem.”

He noted that some of these estates have been abandoned for 10-15 years, majorly because the owners have left public service and can no longer steal money to complete the building.

He, however, said the anti-graft agency has set up a special team that would start visiting such properties to determine the exact owners of each building.

“I have set up the team. We will start visiting all the estates, not only in Abuja but across Nigeria. We want to know who owns what,” he said.

“It will shock you that some of these estates have been abandoned for 10 to 20 years. They just take it to a level, and they abandon it.

“Nobody knows what is going on. What we have been able to gather is that most of these estates were funded by civil servants who have stolen money.

“The moment they leave public service, and the money is no longer coming, they abandon the estate. Then, the developer will start looking for investors to support them to complete the project.”

Speaking on how critical the issue has become, Olukoyede said the agency has had cause to file for forfeiture for about 15 estates in recent times.

“We have gotten more intelligence, too. Some of you sitting in this room, probably some of those estates belong to you,” he said.

“But very soon, we expect to meet you in court because there is no way we will develop this sector if we continue with that attitude. I know some of you have your genuine source of capital.”

Olukayode further warned lawyers and real estate developers to steer clear of being used as a pawn in the money laundering business.

In the meeting, Afam Osigwe, president of the Nigerian Bar Association (NBA), emphasized the need for a centralised system that would enhance the verification of ownership of properties in the country.

He also indicated the need to be cautious with arbitrary revocation of land titles as it could scare away foreign investors.

Meanwhile, Dunamis Church, listed among the defendants, denied encroaching on any property, stating that the land it occupies was lawfully allocated. “We have not violated any boundary,” the church’s lawyer said. “The court’s order to maintain the status quo has been in place since January, and we are in full compliance.”

The dispute over River Park Estate, a large residential development off Abuja’s Airport Road, has triggered parallel criminal investigations. Police have charged three Ghanaians—Sam Jonah, Kojo Ansah, and Victor Quainoo—alongside Nigerian lawyer Abu Arome and Mobus Property Nigeria Ltd. for allegedly forging documents and unlawfully assuming control of the estate’s managing firms.

According to the charges, the suspects manipulated corporate records to allocate 99 million shares to themselves using falsified documents and forged signatures, aiming to seize over 500 hectares of land.

“The defendants misrepresented themselves as Nigerian citizens and submitted forged documents to the Corporate Affairs Commission,” said prosecution counsel, who emphasized the gravity of the offenses.

The case, which intertwines civil claims and criminal charges, continues to draw attention amid concerns over land fraud and property rights in Nigeria’s capital.

Represented by Senior Advocate of Nigeria, A.M. Kotoye, Emefiele argues that he was denied the opportunity to defend his interest in the property. In his petition, he told the court that he was unaware of the proceedings due to what he described as the EFCC’s deliberate concealment of the case.

Claims of Misrepresentation and Procedural Breach

According to Emefiele, the EFCC published the notice of forfeiture in a “barely visible” section of a newspaper, thereby preventing him from seeing or responding to it in time. He further stated that he was simultaneously facing three separate criminal trials in both Lagos and Abuja at the time, which hindered his ability to monitor public notices.

“The commission was in direct communication with me on other matters. It is inconceivable that they would proceed with a forfeiture involving me without proper notification,” Emefiele argued in his filing.

However, the trial court dismissed these claims, ruling that the EFCC had adhered to legal requirements. The judge maintained that the publication of the forfeiture notice satisfied statutory provisions and could not be considered obscure or hidden.

Unconvinced by the ruling, Emefiele filed an appeal on April 30, 2025, requesting the appellate court to set aside the final forfeiture judgment delivered on April 28. His appeal also seeks to nullify both the interim and final forfeiture orders issued on November 1 and December 2, 2024, respectively.

Allegations of Miscarriage of Justice

In his appeal, Emefiele contends that the lower court erred in law and failed to give due weight to the evidence and affidavits he submitted. He claims that the ruling was based on what he called “hearsay, suspicion, and speculative evidence.”

“The court’s refusal to acknowledge my legal and equitable interest in the estate constitutes a grave miscarriage of justice,” he stated.

“The failure to evaluate the evidence presented, and the reliance on procedural technicalities, renders the ruling perverse and unconstitutional.”

Emefiele insists he holds a legitimate claim to the estate, despite the trial court’s finding that he had not provided sufficient proof of ownership.

Appeal Halts Government’s Disposal Plans

Amid ongoing legal proceedings, Emefiele’s legal team has written to the Minister of Housing, requesting an immediate suspension of plans to sell the estate. This comes after the federal government signaled its intention to auction the properties as part of an affordable housing initiative targeting low- and middle-income Nigerians.

“We have served both the EFCC and the relevant ministries with notices of appeal and an application for an injunction,” his counsel confirmed.

“We urge the government to refrain from any disposition of the estate pending the resolution of the appeal.”

The case now moves to the Court of Appeal, where the former central banker hopes to reclaim what he describes as a constitutionally protected property interest. The outcome could have broader implications for asset recovery and due process in Nigeria’s anti-corruption landscape.
