The NDPC found that MultiChoice engaged in the unauthorized collection and transfer of personal data, including information from individuals who were not direct subscribers. The Commission stated that these practices violated Section 37 of the Nigerian Constitution, which protects the right to privacy.

Babatunde Bamigboye, Head of Legal, Enforcement and Regulations at the NDPC, described the data processing activities as intrusive, unfair, and excessive. He emphasized that such breaches are not only unlawful but also pose risks to national security and economic development.

Although MultiChoice was asked to take corrective steps, the NDPC found the company’s response unsatisfactory and lacking cooperation. As a result, the Commission imposed the N766.24 million penalty and announced further investigations into the company’s data handling practices across all its platforms.

Dr. Vincent Olatunji, the NDPC’s National Commissioner, warned that any entity processing Nigerians’ personal data must comply with legal standards or face strict penalties.

The CEO of MultiChoice Nigeria was expected at an investigative hearing at the FCCPC headquarters on February 27, 2025.

However, the hearing has been rescheduled for March 6, 2025, with MultiChoice required to provide a comprehensive response.

The commission mandated MultiChoice to retain its current pricing as of February 27, pending a final decision.

FCCPC emphasized that maintaining existing prices is necessary to prevent potential consumer exploitation during the review.

MultiChoice had previously announced price hikes across its DStv and GOtv packages, effective from March 1, 2025.

DStv Compact would increase from N15,700 to N19,000, while Compact Plus would rise from N25,000 to N30,000.

The highest package, DStv Premium, was set to jump from N37,000 to N44,500, reflecting a 20% price increase.

GOtv subscribers also faced increases, with the GOtv Supa Plus package rising from N15,700 to N16,800.

MultiChoice justified past price hikes by citing Nigeria’s high inflation, which exceeded 30% in 2024.

In 2023, MultiChoice raised prices twice, resulting in a loss of 243,000 Nigerian subscribers between April and September 2024.

The commission warned that these price increases might indicate anti-competitive practices, potentially leading to unfair market exploitation nationwide.

MultiChoice Nigeria’s Chief Executive Officer must attend an investigative hearing on February 27, 2025, at FCCPC headquarters.

The hearing follows numerous consumer complaints about unilateral price adjustments raising concerns about fair pricing practices.

“The FCCPC remains committed to ensuring businesses operate fairly and comply with Nigeria’s robust consumer protection laws,” it stated.

If MultiChoice cannot justify its pricing strategy, the FCCPC will impose sanctions and take necessary enforcement actions.

The commission is collaborating with regulators and agencies to promote competition in Nigeria’s broadcasting and subscription sectors.
