Professional town planners operating under the Nathaniel Atebije Foundation for Planning Advocacy (NAFPA) have urged President Bola Tinubu to safeguard Nigeria’s statutory planning framework amid concerns over recent administrative actions by the Office of the Surveyor-General of the Federation (OSGOF).

In a memorandum submitted to the President, NAFPA commended the administration’s efforts to strengthen inter-agency coordination, enhance development control, and integrate physical planning into broader economic and social development strategies. The group described the current approach as a marked shift from what it termed years of fragmented and reactive urban governance.

According to the planners, aligning political leadership with professional planning principles provides a foundation for sustainable cities, orderly settlements, and efficient land utilisation. They emphasised that physical planning should be regarded as a strategic national development instrument rather than a peripheral technical function.

However, the group expressed concern over a recent announcement by OSGOF regarding the constitution of a Committee on Land Use and Allocation, reportedly inaugurated on January 16, 2026. While the move was presented as part of ongoing land administration reforms, the planners argued that it raises legal and institutional inconsistencies.

They explained that Nigeria’s land governance architecture is primarily anchored on three legal instruments: the Land Use Act, which centralises land ownership and allocation; the Nigerian Urban and Regional Planning Act, which regulates spatial planning and development control; and corresponding state planning laws.

Globally, they noted, land administration—covering ownership, tenure systems, and cadastral mapping—is distinct from land-use planning, which involves zoning, spatial design, and development regulation. Although Nigeria’s legal framework recognises this distinction, the planners warned that distortions arise when land allocation precedes approved planning schemes or when agencies exceed their statutory mandates.

The memorandum stressed that OSGOF’s mandate is largely technical, focusing on geodetic control, cadastral surveys, mapping, boundary delineation, and geospatial data coordination. It does not extend to land allocation, zoning decisions, development approvals, or master plan preparation—functions assigned to planning authorities under existing laws.

Of particular concern is the reported assignment of shoreline planning and management responsibilities to OSGOF, alongside the creation of a Land Use and Allocation Committee within the office. The planners argued that shoreline governance involves environmental zoning, climate adaptation, development control, and resettlement planning—core competencies of certified physical planners.

They further alleged that the composition of the newly constituted committee lacks the multidisciplinary representation envisaged under the Land Use Act. Limited professional inclusion, they warned, could weaken the technical integrity of its decisions and expose them to potential legal challenges.

The group cautioned that altering the statutory sequence—allocating land before preparing approved development plans—could encourage speculation, informal settlements, boundary conflicts, and environmental degradation. According to the memorandum, planning establishes structure, equity, and value, while allocation merely assigns rights within an already structured framework.

Among its recommendations, NAFPA urged the President to reverse the assignment of shoreline management to OSGOF, reaffirm that land-use regulation and development control remain under planning authorities, and consider establishing a Federal Ministry of Physical Planning alongside the Office of the Town Planner-General of the Federation.

In a related development, the Nigerian Institute of Town Planners (NITP) also called for the immediate dissolution of the newly inaugurated Land Use and Allocation Committee. In a letter signed by its President, Ogbonna Chime, the institute described the action as beyond OSGOF’s statutory powers and professionally inappropriate.

The institute cited provisions of the Land Use Act, which require each state governor to establish a Land Use and Allocation Committee with advisory responsibilities on land management and compensation matters. It maintained that the Act does not vest such authority in OSGOF.

NITP further referenced the 2003 Supreme Court judgment in Attorney-General of Lagos State & 35 Others v. Attorney-General of the Federation, which held that urban and regional planning falls within the residual legislative powers of states, except in the Federal Capital Territory.

The controversy is expected to intensify ongoing debates over the balance of federal and state authority in land administration, particularly as reforms in urban planning and property regulation continue nationwide.

Speaking at the opening of the 56th International Conference and Annual General Meeting of the institute at the Nicon Luxury Hotel in Abuja, Ogbonna said effective enforcement of the law is crucial to addressing uncoordinated urban expansion, land misuse, and environmental degradation.

“The way forward is clear, Nigeria must embrace the full implementation of the Urban and Regional Planning Law of 1992, now codified as Cap. 138 of the Laws of the Federation. This Law remains the most comprehensive framework for planning administration in our country.

“Its faithful implementation will ensure coherence among the three tiers of Government, provide for the preparation and periodic review of development plans, establish effective mechanism for development control and strengthen the participation of citizens in shaping their environment.”

He also noted that poor compliance and weak institutional structures have hindered the effectiveness of planning efforts nationwide. According to him, implementing the law will ensure balanced urban growth, improved infrastructure, and better living conditions for citizens.

“If properly implemented, it will reduce haphazard development, stabilize land use patterns, protect the environment, and foster the kind of sustainable and inclusive urban growth we all desire.” He stated

Concluding his address, The NITP President commended the Federal Government for prioritising housing development under the Renewed Hope Agenda, but stressed that housing must be seen as part of a broader urban and regional planning framework. He explained that sustainable cities can only be achieved when planning is properly administered to integrate land use, infrastructure, and social services within a unified development strategy.

“At this point, i must commend the Federal Government for its commitment to the housing sector under the Renewed Hope Agenda. However we must also emphasize that housing is only a subset of urban and regional planning. Whenever planning is rightly administered, housing finds its natural place as part of a larger system of integrated land use, infrastructure and social service delivery”

Ogbonna reaffirmed the NITP’s readiness to partner with the government at all levels to strengthen planning institutions, enforce development control, and promote inclusive urban growth.

The Nigerian Institute of Town Planners (NITP) has intensified its push for sustainable and orderly urban growth by inaugurating a Presidential Committee to liaise with the National Assembly for the full implementation of the 1992 Urban and Regional Planning Law.

Speaking at the inauguration of the committee in Abuja, NITP National President, Dr. Ogbonna Chime, said the legislation passed 33 years ago remains the most comprehensive framework for addressing Nigeria’s persistent urban challenges, including perennial flooding, unplanned settlements, and the proliferation of slums. He urged both the Federal Government and lawmakers to make its activation a top priority.

“This law is not just about town planners; it is about the future of our cities. Implementing it will establish a functional legal structure for planning administration at all tiers of government, promote public participation in development decisions, and ensure major projects undergo Environmental Impact Assessments,” Dr. Chime said.

“The result will be cleaner, safer, and more investment-friendly Nigerian cities,” he added.

The newly inaugurated committee will be chaired by Dr. Ramatu Tijjani Aliyu, former Minister of State for the Federal Capital Territory. She praised President Bola Tinubu’s administration for showing commitment to urban planning.

The former minister pledged that the committee would work closely with legislators to secure the law’s integration into current governance frameworks.

Also present at the event was TPL Morenike Babalola, who commended the NITP’s initiative and called on citizens to cooperate with relevant agencies to ensure the policies succeed.

Earlier, the institute commended the federal government for establishing the Federal ministry of housing and urban development, and also the ministry led by Arc. Ahmed Dangiwa for the ratification of the New Urban Development Policy.

The President of the institute also praised states and local governments while calling for the establishment of the National Planning Commission, local planning authorities and urban and regeneration agencies to fully realize the potential of planning.

The 1992 Urban and Regional Planning Law outlines the creation of planning authorities at national, state, and local government levels, mandates public engagement in the planning process, and sets environmental safeguards for major developments.

According to Dr. Chime, the NITP is determined that, this time, the legislation will not just exist on paper but will be fully enforced to transform Nigeria’s urban landscape.

“We need a solid legal foundation to guide our development processes. Without it, our planning initiatives will lack direction and effectiveness. The law is critical to achieving sustainable urban and regional growth,” Ogbonna noted.

The planned event will bring together a wide array of participants, including lawmakers, state and local government officials, legal experts, NGOs, and professionals from the built environment sector, all of whom are expected to contribute to shaping a more coordinated approach to planning.

In addition to advocacy through the colloquium, the NITP is expanding strategic partnerships to amplify its message. As part of this effort, Ogbonna recently visited Festus Adebayo, founder of the Abuja International Housing Show (AIHS), to deepen collaboration. It will take effect on April 21, 2025. This move is meant to raise more revenue and improve land control in Nigeria’s capital.

Under the new rules, anyone who gets land in Abuja must develop it within two years. This starts from the day their Right of Occupancy begins. If they don’t build within that time, the land will be taken back.

There’s also a 21-day deadline for new land offers. Once someone receives an offer, they must pay all fees and submit an acceptance letter within 21 days. If they fail to do this, the offer becomes invalid even if they try to pay later.

People holding old land papers from area councils should also take note. Abuja treats all land as urban. That means old documents must be checked and updated. Since 2006, over 261,000 land papers have been submitted for regularisation. Only a little over 2,300 have been cleared. The rest are still waiting.

Once a document is cleared, the landowner will have 60 days to pay all charges. If not, the offer will be withdrawn.

The Mass Housing Scheme is also part of the reform. This program started in 2000 to help people get affordable homes. The government gave out 445 housing allocations. But only two developers followed all the rules. Starting April 21, developers and subscribers can now apply for their land titles.

Experts are warning landowners to act now. Ikeoluwa Imam, a town planner, said people should check their land payment status through the Abuja Geographic Information System (AGIS). If any charges are due, they should pay them. Once the fees are paid, no one can take the land—unless it’s for the public good. In that case, the owner must get compensation.

If a land title hasn’t been approved yet, the owner will need to wait for the next regularisation period. Imam also advised residents in estates to apply for official land titles through the FCT lands department.

But Imam had a warning for the minister. He said reforms should not be used to take people’s land unfairly. Nigeria is facing a tough economy. People are struggling. Land seizures should not be used to raise revenue. He reminded the minister that actions taken today will be judged tomorrow.

Odunlami also commended Governor Dapo Abiodun’s administration for mandating collaboration among land-related MDAs and incorporating non-land-related sectors like education and health into urban development strategies.

Former National President of the NITP, Nathaniel Atebije, urged planners to embrace innovation and technology to facilitate the seamless exchange of ideas among agencies. He also announced the upcoming launch of the NITP’s Ten-Year Strategic Development Plan to guide urban planning efforts nationwide.

The Nigerian Institute of Town Planners (NITP) has renewed its call for the urgent review and implementation of the Nigerian Urban and Regional Planning Law of 1992. National President, Tpl. Nathaniel Atebije, emphasized the significance of enforcing the law to ensure sustainable urban development and effective physical planning across the country.

Addressing the conference’s opening ceremony during the 55th International Conference of the institute in Enugu, Atebije expressed concern over the slow domestication of the law. “It is disheartening that 30 years after the enactment of this crucial planning law, only a few states have domesticated it.

The Federal Government and most states have yet to take decisive steps to enforce it,” he said. He highlighted the law’s potential to promote organized urban growth, economic development, and sustainable communities.

Tpl. Kabir Yari, the Lead Paper presenter and Managing Director of Pragmatic Solutions Limited, presented a comprehensive overview of the obstacles facing urban planning in Nigeria. As a seasoned urban planning consultant, Yari outlined critical issues that hinder proper enforcement and effective planning in the country.

Yari noted, “The challenge we are having is not only in the class but in the provisions for policies. First, there is supposed to be a National Environmental Plan and Development Policy that the law mandates, along with education and training provisions. Promotion of cooperation and coordination amongst states and local governments in the preparation and implementation of urban and regional plans is essential.”

He stressed that without a National Fiscal Planning Commission, which was intended to include various key sectors like land, finance, transport, communications, housing, and representatives of the states and Federal Capital Territory (FCT), the issue of coordination remains a persistent challenge. This, he explained, has led to misalignment in national plans, hindering progress.

Yari discussed the evolution of Nigeria’s development planning, highlighting the transition from National Development Plans in the 1950s to the current National Development Plan 2021-2025. He emphasized that the National Development Plan 2021-2025 aims to unlock the country’s potential through economic diversification, infrastructure investment, and poverty reduction. However, he noted that achieving these goals would require adherence to planned urbanization and the implementation of supportive policies and frameworks.

Reflecting on global perspectives, Yari referenced the World Bank’s observation on Nigeria’s urbanization efforts: “The World Bank says Nigeria’s economic potential is huge if it can get urbanization right, but tremendous costs await if it continues with business as usual.” He echoed the Bank’s warning that unplanned urbanization could jeopardize Nigeria’s socio-economic growth.

In his presentation, Yari also delved into the significance of establishing a National Fiscal Development Plan to synchronize different sectors and foster balanced regional development. He shared insights from neighboring African countries, such as Ghana and Kenya, where fiscal planning has been effectively integrated into their national budget processes and development strategies. Yari pointed out that in Kenya, it is constitutionally mandated for each county to prepare an Integrated Development Plan, ensuring a coordinated and sustainable approach to urban and regional planning.

Further emphasizing the importance of regional planning, he brought attention to successful projects like the Lekki Corridor in Nigeria, a key integration of road, rail, and telecommunication infrastructures supported by USAID. He reiterated that comprehensive regional planning is indispensable for national growth, balanced development, and industrialization.

President Atebije reiterated NITP’s commitment to engaging the government in developing and implementing comprehensive national, regional, and local master plans to tackle environmental issues like flooding. “Prosperity thrives in an orderly, functional, and aesthetically pleasant environment,” he stated, calling on the government to prioritize physical planning as an essential pillar for national development.

The opening ceremony also included the presentation of awards by the Deputy Governor of Enugu State, Barr. Ifeanyi Ossai, on behalf of the Institute to Tpl. Lami Ayuba, Chairman of the FCT chapter. He added that his decision to pursue town planning, despite the uncertainties, ultimately became a life-changing moment. Drawing parallels, he encouraged the inductees to embrace the field with passion and purpose, reminding them of the crucial role town planners play in creating sustainable and livable communities.

Tpl. Commissioner for Physical Planning and Urban Development, Dr. Oluyinka Olumide made this known recently in Alausa during a courtesy visit to the ministry by the National President of the Nigerian Institute of Town Planners, Tpl. Nathaniel Atebije.

The Commissioner said that one of the ways to enhance the performance of staff is through training and retraining and that the collaboration of NITP would be quite instructive in this regard.

He emphasised that investing in human capital would enhance employee’s exposure and propel the development of the state, adding that the 21st-century Lagos required dexterity with modern planning tools.

His words: “ For us to be relevant, we must be ready for change, and this is best done through adequate capacity enhancement. We must challenge ourselves to do the same thing in different ways that will produce the desired best results. “

The Permanent Secretary, Office of Physical Planning, Engr. Oluwole Sotire said that the visit of NITP was timely as it came at the time when the Office was in the process of completing the review of Alimosho Model City Plan, which is currently at the public display stage while the preparation of the Lagos Island Model City Plan would soon reach the final stakeholders meeting stage.

The National President, Nigeria Institute of Town Planners, Tpl. Nathaniel Atebije said that the institute was aware of the efforts of the State Government towards the sustainability of the built environment , particularly the engagement of Town Planners and other professionals in recent times, while calling on State Government to recruit more Town Planners and other related professionals to enhance the implementation of development plans.

He disclosed that the Institute was very much ready to support the training needs of the Ministry, saying that its rich training manual was quite instructive.
