FCT Court Restrains Developers From Al-Barka Estate Land

A High Court of the Federal Capital Territory (FCT), Abuja, has ordered developers of Al-Barka Estate and other parties to halt further activities on the disputed land in Wuye District pending the determination of a suit on ownership.

The order followed a legal dispute over a large parcel of land designated for the proposed Al-Barka Estate project.

Details Of The Suit

The case, filed on January 20, 2026, is before Court 63 of the Federal Capital Territory High Court in Suit No. FCT/HC/CV/216/2026.

The claimants, Promise Land Building and Construction Limited and two others, instituted the action against Goldenbird Investment Limited and another defendant.

According to court documents, the dispute involves Plots 1841, 1842, 1843, and 1844 in Cadastral Zone BO3, Wuye District, Abuja.

Competing Ownership Claims

Goldenbird Investment Limited, the first defendant, asserts that it has been in possession and control of the land since 2007. The company claims to have operated a recreational facility known as Golden Bird Park on the site while maintaining it as part of the green zone under the FCT Master Plan.

During proceedings on February 16, counsel to Goldenbird and lawyers for parties seeking joinder informed the court of an alleged breach of an earlier order made on January 28, 2026.

The court was told that despite initiating the suit, the claimants allegedly forcefully took possession of the property on February 6, 2026.

Court Orders Status Quo

In response, the judge directed all parties to maintain the status quo and refrain from any development or interference with the disputed property until the substantive suit is determined.

The court held that preserving the subject matter of the litigation was necessary and granted an accelerated hearing of the case.

The judge also cautioned parties against taking unilateral actions and emphasised respect for the authority of the court pending resolution of the ownership dispute.

Copies of the restraining order have reportedly been pasted on the property and served on all parties, with an additional copy forwarded to the Nigerian Police for enforcement.

The matter has been adjourned to March 19 for hearing.
